Who we are
CapQuick is an iOS app made by Justin Hammon, an indie developer based in the United States. When we say "we" or "us" on this page, that's who we mean.
Accepting these terms
By installing or using CapQuick, you agree to these terms. If you don't agree, don't use the app. You also agree to Apple's standard Licensed Application End User License Agreement, which the App Store applies to every app.
Who can use CapQuick
You need to be at least 13 to use CapQuick (or older if your country sets a higher age for using app stores). If you're under 18, you should have a parent or guardian agree on your behalf.
The license
We grant you a personal, non-transferable license to install and use CapQuick on iPhones you own or control, through the App Store. The license is non-exclusive and revocable if you violate these terms.
Don't reverse engineer the app, copy it, redistribute it, or try to extract its source. Don't strip the watermark from free exports through anything other than upgrading to Pro.
Free vs Pro
CapQuick Free includes everything you need to record, caption, and share videos. Free exports include a small "made with CapQuick" watermark.
CapQuick Pro is a one-time purchase ($9.99 USD or local equivalent at the time of writing). Pro removes the watermark and unlocks saved branding profiles. Pro carries forward to future Pro features at no extra charge unless we say otherwise in advance for a major new product.
"One-time" means one-time per Apple ID, on iPhones running compatible iOS. You can restore your purchase on any iPhone signed in with the same Apple ID using the in-app restore option.
Refunds
App Store purchases are handled by Apple. If you want a refund, request one through Apple at reportaproblem.apple.com. We don't process refunds directly.
Your content
Anything you record, import, caption, or export with CapQuick is yours. We don't claim ownership of your videos.
If you share content captioned with CapQuick, you're responsible for what's in it.
Acceptable use
Don't use CapQuick to record, caption, or share content that:
- Breaks the law where you live or where the content will be seen.
- Harasses, threatens, or stalks anyone.
- Infringes someone else's copyright, trademark, or other rights.
- Captures someone in a private setting without their consent in jurisdictions that require it.
- Promotes child sexual abuse material, terrorism, or imminent violence against people.
We don't actively scan your videos. But these are the limits of the license.
Apple's role
You acknowledge these terms are between you and us, not between you and Apple. Apple is not responsible for the app or for support, but Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
App availability
We work hard to keep CapQuick reliable. We can't guarantee it'll be available everywhere, on every iOS version, or forever. If we discontinue the app, we'll give you reasonable notice and you can keep using your current installed version on your iPhone for as long as iOS supports it.
As-is
CapQuick is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Captions are generated by automatic speech recognition and may contain errors. Always review captions before exporting and sharing.
Limit on liability
To the maximum extent allowed by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of CapQuick. Our total liability to you for direct damages is limited to what you paid us in the past 12 months, which for most users is the one-time Pro purchase price (or $0).
Indemnity
You agree to defend and hold us harmless from claims that arise out of your content, your use of CapQuick, or your violation of these terms.
Changes to these terms
We may update these terms over time. If we make a material change, we'll update the date at the top and call out the change on the homepage before it takes effect. Continued use of CapQuick after the change means you accept the updated terms.
Governing law
These terms are governed by the laws of the United States and the State of Kansas, without regard to conflict of laws principles. If you live somewhere with mandatory consumer protections, those still apply to you regardless of this clause.
